MINUTES OF LIMA CITY COUNCIL
LIMA, OHIO
January 4, 2010
The Council of the City of Lima met in regular session at 7:30 p.m.
Attending were: Tony Geiger, Law Director; David Geiger, Asst. Law Director; Randy Bartels, Dir. of Audit Services; Catherine Garlock, Chief of Staff; Steven Cleaves, Finance Director; Vince Ozier, Dir. of Human Resources; Amy Odum; Dir. Of DCD; Gary Sheely, Dir. of Util.; Howard Elstro, Dir. of Public Works; Chief Garlock, and Sally Clemans, Clerk.
The invocation was given by Councilor Townsend followed by the Pledge of Allegiance.
Judge RicKard Workman administered the Oath of Office to Kurt Neeper, 1st Ward Councilor; Jesse J. Lowe, II, 3rd Ward Councilor; Teresa G. Adams, 5th Ward Councilor; and Paige Townsend, 7th Ward Councilor.
ROLL CALL showed the following members present: Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon.
D. Adams moved to amend the agenda by adding communications 9 and 10 and ordinance 012-10, seconded by Townsend, motion carried.
THE FOLLOWING ITEMS WERE PRESENTED ON THE CONSENT CALENDAR:
a. Minutes of the previous meeting not read since each received a copy.
b. Bd. of Health minutes of December 11, 2009.
c. Bd. of Building Appeals minutes of December 17, 2009.
D. Adams moved that item "a" of the consent calendar be received, filed, and approved and that items "b-c" be received and filed, seconded by Townsend, motion carried.
THE FOLLOWING COMMUNICATIONS WERE PRESENTED:
1. From the Finance Director requesting legislation for the 2010 Temporary Appropriations. Moved by Tebben, seconded by McLean, that the communication be received and filed. Legislation is on the agenda. Motion carried.
2. From the Finance Director requesting legislation to enter into contract with MSGovern. Moved by Tebben, seconded by McLean, that the communication be received and filed. Legislation is on the agenda. Motion carried.
3. From the Director of Human Resources requesting legislation to amend the agreement with the FOP Rangers. Moved by Glenn, seconded by T. Adams, that the communication be received and filed. Legislation is on the agenda. Motion carried
4. From the Director of Human Resources requesting legislation to establish pay and benefits for the Fire Chief and Assistant Fire Chiefs. Moved by Glenn, seconded by T. Adams, that the communication be received and filed. Legislation is on the agenda. Motion carried
5. From the Director of Community Development regarding the 2008-2009 Consolidated Annual Performance and Evaluation report. Moved by Townsend, seconded by D. Adams, that the communication be received and filed. Motion carried.
6. From the Director of Community Development requesting legislation to place demolition assessments. Moved by Townsend, seconded by D. Adams, that the communication be received and filed. Legislation is on the agenda. Motion carried.
7. From the Director of Public Works requesting legislation to enter into agreement with Allen County Council on Aging. Moved by Neeper, seconded by Tebben, that the communication be received and filed. Legislation is on the agenda. Motion carried
8. From the Director of Public Works requesting legislation to enter into contract with CDA Construction Group. Moved by Neeper, seconded by Lowe, that the communication be received and filed. Legislation is on the agenda. Motion carried
9. From the Council President regarding committee appointments. Moved by Townsend, seconded by Adams, that the communication be received, filed and approved. Motion carried.
10. From Judge Workman requesting legislation for purchases from the 2010 Appropriations Computer and Special Project fund. Moved by McLean, seconded by Tebben, that the communication be received and filed. Legislation is on the agenda. Motion carried.
THE FOLLOWING ORDINANCES WERE PRESENTED:
001-10 Making preliminary appropriations for current and ordinary expenses of the City of Lima, Ohio, for the period beginning January 1, 2020, until the Annual Appropriation Ordinance of the City of Lima, Ohio, is in force, and declaring an emergency. Tebben moved, seconded by Townsend, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
002-10 Levying a special assessment for demolition charges for dangerous structures in the City of Lima, Ohio, and declaring an emergency. Townsend moved, seconded by D. Adams, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
003-10 Authorizing the Mayor to enter into contract with MSGovern for maintenance and support of the Gems Software, and declaring an emergency. Tebben moved, seconded by Glenn, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
004-10 Authorizing the Mayor to amend the Collective Bargaining Agreement with FOP Ranger Employees to provide an Optional Health Care Benefit Coverage Plan to carve out coverage for employee spouses; and declaring an emergency. Glenn moved, seconded by T. Adams, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. 005-10 Amending Section 244.255 of the Codified Ordinances of Lima, Ohio, concerning pay and benefits of the Fire Chief and Assistant Fire Chiefs and declaring an emergency. Glenn moved, seconded by Townsend, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
006-10 Authorizing the Mayor to enter into contract with CDA Construction Group, Inc. For demolition of residential structures for the 2010 calendar year, and declaring an emergency. Tebben moved, seconded by Townsend, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. Miss Adams requested a list of the 2010 demolitions from Mr. Elstro. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
007-10 Authorizing the Mayor to enter into an Agreement with Allen Council on Aging, Inc., and declaring an emergency. Neeper moved, seconded by Lowe, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. 008-10 Authorizing the Mayor to apply for, receive and administer a Federal Emergency Management Agency Grant to hire additional firefighters, and declaring an emergency. T. Adams moved, seconded by Lowe, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
009-10 Authorizing the Auditor to make payment to the Ohio EPA, and declaring an emergency. McLean moved, seconded by Tebben, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
010-10 Amending Ordinance No. 82-96; and declaring an emergency. McLean moved, seconded by Glenn, that the ordinance be amended in Section 1. By deleting .00 and making it an amount not to exceed $69,280.00. Motion carried. McLean moved, seconded by Glenn, that the rule requiring three readings be suspended and the ordinance passed on the first reading, as amended, as an emergency. Miss Adams said she requested information from Mr. Caprella regarding the amount of change orders and she thanked him for getting this information to her. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading, as amended, as an emergency by a 9-0 vote.
011-10 Authorizing the Mayor to enter into an Agreement with GE Fanuc Intelligent Platforms, Inc. For software renewal and support, and declaring an emergency. Lowe moved, seconded by Glenn, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
012-10 Authorizing payment from the Lima Municipal Court Computer and Special Projects Funds, and declaring an emergency. McLean moved, seconded by Lowe, that the rule requiring three readings be suspended and the ordinance passed on the first reading as an emergency. The following vote was recorded on the motion. Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading as an emergency by a 9-0 vote.
MISCELLANEOUS BUSINESS:
Councilor Townsend wished everyone a Happy New Year and welcomed the two new members and the one returning. She thanked her Mother for being here tonight.
Councilor David Adams welcomed the new and returning members. He thanked Teresa Adams for increasing the Adams by 50%. He announced the Riverside North N/A meeting on Thursday at the Red Cross Building. He said his poem is appropriation for the New Year. "The Road Not Taken" by Robert Frost.
Councilor Neeper gave his phone number for the public. He thanked Jim Birney, his fiancee, Jerilyn and his family and friends for being here tonight.
Councilor McLean welcomed the new members. He announced the meeting on Wednesday, January 6th at Lima Senior concerning the mail process. He said this needs public input. He encouraged everyone to attend the meeting at 7:00 p.m. It would mean a huge loss of jobs.
Councilor Lowe thanked everyone for the opportunity to serve. He thanked the 3rd Ward people who voted for him and those who did not vote for him. He said I believe in unity in the city and I believe we can make this happen.
Councilor Tebben welcomed the new and returning members. He said the meeting at Lima Senior on Wednesday is very important. These decisions are made sometimes by people who do not live in our community. Tebben moved, seconded by Lowe, that texting while driving be referred to the Safety Services Committee. Motion carried. Tebben moved, seconded by D. Adams that the issue of rental property inspection, registration and rules regarding rental properties, be referred to the Building, Planning and Zoning Committee as the primary committee with the Neighborhood Concerns committee as the secondary committee. Motion carried.
Councilor Teresa Adams thanked everyone who supported her. She thanked her relatives for coming from Dayton and here friends for standing up with her. She noted that in the Board of Health minutes 37,000 visits took place at the Allen County Health Partners. She said what an asset this is to the Community. She said it is very important to attend the public hearing for the postal service. T. Adams moved, seconded by Glenn, that the issue of the removal of a four way stop and parking on Eureka Street be referred to the Traffic Commission. Motion carried. She said she appreciates the well wishes and looks forward to working with Council.
Councilor Glenn congratulated the new Council members. He said the 6th ward people need to step up. He does not want to see any more half way houses in the 6th ward. He does have a sponsor for Kid of the Week. They need to work on more volunteers. He will be working on the Dr. Martin Luther King banquet.
President Nixon reiterated the importance of the postal hearing on Wednesday. He congratulated the new members of Council. He looks forward to working with all of them to make 2010 the best ever.
Tebben moved, seconded by T. Adams, that Council adjourn to Executive Session for matters of real estate and litigation. The following vote was recorded on the motion: Yea, 9; Neeper, McLean, Lowe, Tebben, T. Adams, Glenn, Townsend, D. Adams and Nixon. Council adjourned to Executive Session.
Council reconvened from Executive Session and Tebben moved that Council adjourn until January 25, 2010 at 7:00 p.m., seconded by Townsend, motion carried.
